Selling, Manufacturing and Possession with Intent to Distribute Marijuana

The New Jersey Criminal Code makes marijuana distribution an indictable offense. What this means is that your case can only be handled at the Monmouth County Superior Court and that you will have a felony criminal record if you are convicted. Possession with intent to distribute less than one (1) ounce of marijuana is a fourth degree crime that carries up to 18 months in prison and a $10,000 fine in the event of conviction. Selling at least one (1) ounce but less than five (5) pounds of marijuana is a third degree crime that results in a maximum fine of $25,000 and up to five (5) years in prison. It is a second degree crime in the event someone is found guilty of distribution involving marijuana of at least five (5) pounds but less than twenty-five (25) pounds. The period of incarceration is five (5) to ten (10) years and you can be fined $150,000. Manufacturing, selling or distributing marijuana in the amount of twenty-five (25) pounds or more is a first degree crime that subjects the defendant to a fine that can reach $300,000 and up to twenty (20) years in state prison. A conviction for any drug offense, even possession of marijuana in the slightest quantity, carries with it a mandatory driver’s license suspension of at least six (6) months and as much as two (2) years. All of these penalties escalate dramatically when someone is convicted of intent to distribute or selling marijuana in a school zone or public park zone. These areas are afforded enhanced protection under the law and trigger even more serious consequences when someone violates the law by selling drugs in these locations.
