The offense of simple assault is set forth at N.J.S.A. 2C:12-1(a). A person is guilty of this charge if he/she does any of the following:

  1. Attempts to cause bodily injury;
  2. Purposely, knowingly or recklessly causes bodily injury;
  3. Negligently causes bodily injury with a deadly weapon; or
  4. Attempts to put someone into fear of serious injury by physical menace.

If an individual engages in any of these acts, they commit a disorderly persons offense. The only exception to this grading is where the conduct arises out of a fight or scuffle by mutual consent and then it is a petty disorderly persons offense. The maximum penalties for a 2C:12-1(a) violation is a $1,000 fine and six (6) months in jail.
