- Attempts to put someone into fear of serious injury by physical menace.

The only exception to this grading is where the conduct arises out of a fight or scuffle by mutual consent and then it is a petty disorderly persons offense. The maximum penalties for a 2C:12-1(a) violation is a $1,000 fine and six (6) months in jail.
